General Contracting Conditions

1. General Information

This document establishes the general conditions governing the use of and the purchase of products through the website www.iberianselectfoods.com, owned by IBERIAN SELECT FOODS SL, holder of Tax ID (NIF) B22844773. For any inquiries, you may contact our team via the CONTACT form available on the website or by email at admin@iberianselectfoods.com.

2. Purpose

The purpose of this website is the remote commercialization of Iberian products and accessories, primarily aimed at end consumers, in accordance with current regulations on electronic commerce, consumer protection, and distance selling.

3. Applicable Regulations

The contractual relationship between the user and IBERIAN SELECT FOODS SL is governed by the following Spanish and European regulations:

Law 7/1998, of April 13, on General Contracting Conditions.
Royal Legislative Decree 1/2007, of November 16 (as amended by Law 3/2014), the General Law for the Defense of Consumers and Users.
Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSI-CE).
Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD), regarding personal data protection.
Law 7/1996, of January 15, on the Regulation of Retail Trade.

4. Modification of Conditions

IBERIAN SELECT FOODS SL reserves the right to modify these conditions at any time and without prior notice. Modifications will be applicable from their publication on the website. In the case of substantial changes, registered users will be informed beforehand. Specific conditions may be established that prevail over general ones in case of contradiction, provided the user is informed in advance.

5. User Registration

To make purchases, users must register by creating an account with a personal and non-transferable username and password. The user agrees to maintain confidentiality and notify the company of any unauthorized use. Users can view order history and modify personal data in the "Customer Area."

6. Legal Capacity

By accepting these conditions, the user declares:

To be over 18 years of age.
To have sufficient legal capacity to enter into a contract.
To have read, understood, and fully accepted these conditions.

7. Purchase Process

The purchase process will always be that stipulated by the Shopify platform. Upon completion, the user will receive a confirmation email. If not received within 24 hours, the user should contact customer service via the CONTACT form.

8. Prices and Taxes

All prices are expressed in Euros (€) and include the Value Added Tax (VAT/IVA) currently in force in Spain.

9. Payment Methods

The customer may choose from the payment options offered by the Shopify platform. In the event of a fraudulent or unauthorized charge, the cardholder may request the cancellation of the order, provided it has not yet left our warehouse. If already shipped, the customer must file a report with the competent authority. If a chargeback is found to be improper or not based on the right of withdrawal, the cardholder shall be liable to compensate IBERIAN SELECT FOODS SL for damages.

10. Shipping Policy

Delivery: Monday to Friday to private homes or offices.
Delivery Times: Normally between 10 and 30 business days, depending on the season and product preparation.
Verification: The customer must check the package upon receipt. If no issue is reported within 7 calendar days, the order is considered accepted.
Unavailability: If a product is unavailable after the order is placed, the customer will be notified within 30 days and offered a similar/superior product or a refund.

11. Returns and Lack of Conformity

Right to Return: Customers have 15 days from receipt to report defects or discrepancies.
Replacement: If accepted, the item will be replaced at no cost to the customer. If unavailable, a refund will be issued.
Weight Requirement: For hams and charcuterie, at least 85% of the original weight must be returned. Pieces missing more than 15% will not be accepted.
Exclusions: This protocol does not apply to whole pieces (hams/shoulders) sliced or deboned by third parties (butchers, external companies, etc.) other than IBERIAN SELECT FOODS SL. The piece must remain intact and include the Black Iberian Select Foods Guarantee Label.
Sliced Products: If the flavor of a sliced pack is unsatisfactory, we recommend trying a second pack (as flavor varies). If still unsatisfied, notify us via the CONTACT form.
Other Products: For cured meats, cheeses, or oils, claims must be made within 15 days of receipt. After this period, no solutions can be offered.

Instructions for Returns: Please contact customer service via the CONTACT section with:

Photos of the current state of the product showing the defect and the guarantee seal.
A brief explanation of the issue.
Order number. We will arrange collection from your home for analysis by our quality experts.

12. Data Protection

Personal data is processed in accordance with the GDPR and LOPDGDD. Users may exercise their rights of access, rectification, erasure, and portability by emailing admin@iberianselectfoods.com.

13. Contract Language

The official language of the contractual relationship is Spanish. While the website may be available in other languages, the Spanish version shall prevail in the event of any claim or discrepancy.
